Charlotte Osei EC Boss
President Nana Addo Dankwa Akufo-Addo has referred the petition seeking to impeach the Chairperson of the Electoral Commission, Mrs Charlotte Osei, to the Chief Justice in accordance with Article 146 (3) of the Constitution.
According to the Communications Bureau of the Flagstaff House, the President received the petition, initially undated and unsigned, against the EC Chairperson while he was outside the country.
Subsequently, it said the counsel for the petitioners, Maxwell Opoku Agyemang, by a letter dated July 20, 2017, wrote to the office of the President setting out the names of the petitioners and the date of the petition.
The Chief Justice, Ms Sophia Akuffo, is expected to determine whether there is a prima facie case against the EC Chairperson and, if a case is established, set up a committee to deal with the matter.
Article 146 (4) of the Constitution states that the committee must consist of “three Justices of the Superior Courts or chairmen of the Regional Tribunals or both, appointed by the Judicial Council and two other persons who are not members of the Council of State, nor members of Parliament, nor lawyers, and who shall be appointed by the Chief Justice on the advice of the Council of State.”
The committee is expected to investigate the complaint and make its recommendations to the Chief Justice who shall forward it to the President.
The allegations against the EC boss range from breach of procedures at the EC, breach of financial laws, contempt towards deputy commissioners, to bad human relations.
