The Rent Control Department (Kumasi) of the Ministry of Works and Housing has been reminded to be wary of illegal methods to compel one Nana Yaw Apea to yield possession of a portion of a family house, H/No. Plot 11, Block 4, New Amakom Extension in Kumasi he lawfully occupies.
Lawyer Kwasi Afrifa of O & A Legal Consult, Solicitors of Apea, reminded the Rent Control office that state power cannot be abused so blatantly in the current dispensation of the land and desist from illegal use of office in a purely family matter.
The law firm cautioned the Ministry of Works and Housing, under which the Rent Control operates, and a family member of the said property not to hide under the guise of the Rent Control Unit to perpetrate illegality and pursue personal vendetta.
O &A Legal Consult, per correspondence of September 11 and 23, 2020 by its Senior Partner, indicated that it had no problem with persons seeking the ejection of its client, if it headed to court to achieve that purpose, rather than adopt illegal means through abuse of power and office.
Nana Yaw Apea has been advised not to appear before the Rent Control office as ownership of the property had not been determined in court and the fact that its client is a member of the family and that nobody can purport to eject him.
O &A Legal Consult has consequently served notice that any further harassment of its client would compel them to resort to legal processes to assert the rights of the client in court.
The law firm indicated that it is impermissible to abuse the Rent Control office or permit any person to abuse the powers vested in the office and thus intimidate the office (Rent Control) which is an adjunct of the Works and Housing Ministry.
Nana Yaw Apea lives in the said house, constructed by the deceased grandfather and, therefore, has never been a tenant, while the Complainant seeking ejection of Apea happens to be a Cousin.
The Solicitor said the claim for arrears of rent is only a fabricated device having no basis in law or fact and that the claim of recovery of possession is similarly misconceived and designed merely to embarrass Apea.
As a result, the Legal firm has drawn the attention of the Registrar of the Kumasi High Court, the Judicial Secretary and the Minister of Works and Housing of the gross attempt by the rent Control Office to assume control over matters outside its jurisdiction.
The Ministry of Works and Housing has also been reminded of the impermissible use of powers of office for illegal actions.
The Rent Control Office in Kumasi on September 17, 2020 summoned Nana Yaw Appiah (wrong name) to answer complaints of Rent arrears and recovery of possession, which have been denied.
The complainant in the case, Apea Henebeng, cousin to Apea (respondent) claims he offered a two bedroom flat at a monthly rent of GHc150 which tenancy expired in May, thus the Respondent is in arrears of GHC600.00 as at September 30, 2020 and has failed vacate the premises on notice.
