The Member of Parliament (MP) for Subin, Eugene Boakye Antwi, and the Ashanti Regional Chairman of the New Patriotic Party (NPP), Bernard Antwi Boasiako, have been summoned to court via substituted service to respond to alleged contemptuous and deliberate acts intended to bring the authority of the court into disrepute.
Since June 19, court bailiffs have had a tough time serving a motion on notice seeking an order for committal of the respondents for contempt. After two adjournments, the only option left for the bailiffs was to resort to substituted service.
The notice has been pasted at the Regional Secretariat of the New Patriotic Party (NPP) and the Subin constituency office at Asafo, in the resolve of the applicants to ensure justice.
By this development, the respondents, including Patrick Acheampong, Ashanti Regional Director of Research and Election, the Subin Constituency Chairman, Michael Adusei Bonsu, and his Secretary, Akuamoah Boateng, would have to appear before the court on August 17, 2020.
The 51 applicants are seeking a declaration that the June 20 NPP polls, by which the sitting MP claims to have been re-elected by 485 votes, was illegal, unlawful and wrongful, and should be declared null and void.
Last July 21, 2020, the Kumasi High Court (4), presided over by His Lordship Justice Charles Wilson, adjourned the determination of the case to July 28, 2020, because the motion on notice had not been served on all respondents, except the Constituency Secretary, Akuamoah Boateng.
Even though the Electoral Commission (EC), first respondent, was absolved in the application, the judge insisted that the Regional Electoral Officer had to appear in court in person, noting that non-representation in court was, in itself, contemptuous in a contempt case seen as quasi- criminal.
