In an application filed at the High Court, the Bolgatanga East MP argued that his arrest by the police CID in connection with the matter, is a clear violation of his human rights.
According to Dr. Ayine, the police CID exceeded its investigative powers when it failed to provide any evidence of alleged double payment and also failed to show probable or reasonable cause of action that he was paid the said amount during questioning upon his arrest.
Dr. Ayine is, therefore, praying the court to restrain the police to “cease and desist from taking any further action in this matter until the final determination of this case.”
Twenty-five of the MPs were initially asked to report to the police, but 18 of them were later asked to disregard that invitation.
The police, during its investigation, interrogated a number of the accused MPs.
Per the dictates of public service, an official who occupies both positions is entitled to a single salary, equal to the level of a Minister of State.
