President Akufo-Addo has been petitioned to remove from office a High Court Judge, Justice Gifty Agyei Addo, who was recently nominated to the Court of Appeal.
The petitioner, a real estate developer, Marian O’Sullivan, in the petition accuses the judge of abusing her office and privileges by procuring a High Court judgment based on a forged document and interfering in a case before a court.
Justice Adjei Addo has also been accused of unlawfully demolishing a fence wall being constructed by the petitioner’s company.
Justice Gifty Adjei Addo, who sits in the Human Rights Division of the High Court is well known for her judgment which overturned the General Legal Council’s suspension of the license of the current Member of Parliament for Madina, Francis Xavier-Sosu.
Per Ghana’s constitution, when the President receives such a petition, he is required to refer it to the Chief Justice, who shall determine whether, at first impression, the allegation can be accepted or not.
Where the Chief Justice concludes that as being the case, he shall set up a committee consisting of three Justices of the Superior Courts or Chairmen of the Regional Tribunals or both, appointed by the Judicial Council and two other persons who are not members of the Council of State, nor members of Parliament, nor lawyers, and who shall be appointed by him on the advice of the Council of State” to probe the matter.
The committee then investigates and makes its recommendations to the Chief Justice, who will forward this to the President.
