An Accra High Court has admitted into evidence confession caution and charge statement given by Daniel Asiedu aka Sexy Don Don, who is the prime suspect in the murder of the then Member of Parliament of Abuakwa North, JB Danquah-Adu, as well as that of Vincent Bosso.
The court presided over by Justice Lydia Osei Marfo, admitted the statements in evidence after she held that they were given voluntarily by the accused person as against claims by his lawyer that he was tortured into given them.
Sefakor Batse, a Principal State Attorney, on July 19, 2022, had attempted to tender the statements which were taken on February 11, 2016, through the case investigator, Chief Inspector Augustus Nkrumah.
But the move was opposed by Yaw Dankwa, counsel for the accused, who argued that his client did not give the said statements voluntarily to the police but was rather threatened, put under duress and treated inhumanly to give the statements.
The court subsequently put the main trial on hold in order to hold a mini trial to determine the admissibility of the confession statements.
The prosecution called the investigator and independent witnesses in whose presence the statements were made, taken and read back to the accused persons.
They all testified in open court and in the presence of the accused and led evidence as to how the statements of both accused persons were taken at the police station.
They were all cross examined by counsel for the accused persons. The accused persons also opened their defence and claimed the statement were not willingly given to the police as they were tortured into giving them.
Justice Marfo in her ruling stated that having looked at the various statements tendered by the prosecution, evidence of prosecution witnesses as well as the defence of both accused persons, it was her opinion that the statements were made voluntarily by the accused persons.
She said the accused persons were not coerced by the police to make any statements, neither were they promised any favours before they voluntarily gave their cautioned or charged statements.
She therefore, overruled the objection by the defence counsel and admitted the statements into evidence.
Justice Marfo adjourned the case to April 25, although she was not sure if the jury will be available to hear the case due to an ongoing strike by jurors to protest the non-payment of their allowances.
