
The Koforidua High Court has struck out the injunction applications against the Members of Parliament (MPs) for the Suhum and Nsawam-Adoagyiri constituencies.
The court ruled that the injunctions had no bearing on the recent developments since both MPs had already been sworn in on January 7, 2025.
The petitioners for both constituencies withdrew their applications for an injunction against the declared MPs, citing the passage of time and the irrelevance of the injunctions, given that the MPs had already taken office.
The defendants also withdrew their applications to set aside the election petition in the Nsawam-Adoagyiri case.
The results for the two constituencies were as follows: In Nsawam-Adoagyiri, the Electoral Commission declared Frank Annor Dompreh of the NPP as the winner with 29,640 votes, while Selorm Phillibert Fummey of the NDC received 29,433 votes. In Suhum, Frank Asiedu Bekoe of the NPP was declared the winner with 16,855 votes, while Prince Kwadwo Addo Tabiri of the NDC received 15,259 votes. Independent candidate Kwadwo Asante received 14,860 votes, and Dede Wiafe, the fourth candidate, received 159 votes.
The petitioners were represented by Lawyer Michael Numekevor, while the defendants were led by Gary Nimako Marfo.
The injunction applications in both cases sought to restrain the swearing-in of the declared MPs. However, since both MPs have already been sworn in, the court cannot issue a restraining order for something that has already occurred.
Therefore, the court struck out the injunction applications as withdrawn.
The petitioners and respondents have been instructed to reappear before the court once the necessary processes have been filed.
No specific dates were set, as the next court date will depend on the progression of these processes.
In the case of Nsawam-Adoagyiri, the respondent, Hon. Annor Dompreh, has filed his response to the petition, and the petitioner must file a reply before a date can be scheduled. In the Suhum case, the respondent is yet to file their response.
The respective suits will proceed through their normal course and have been adjourned until the necessary filings are completed.
The petitioners are seeking to overturn the Electoral Commission’s declarations of the NPP candidates as winners in the Suhum and Nsawam-Adoagyiri parliamentary elections, citing alleged material infractions during the collation of results. They claim that they were the true winners in both constituencies.
