The apex court has dismissed an application by lawyers of Assin North Member of Parliament James Gyakye Quayson seeking to overturn its decision ordering Parliament to delete his name from their records.
The nine-member panel had earlier ruled that his name be expunged following a judgment bringing to naught all the processes leading to his election and swearing-in as MP for Assin North.
In court on Tuesday, July 25, 2023, lead Counsel Tsatsu Tsikata argued that the Supreme Court’s decision was tantamount to a miscarriage of justice. He added that the apex court should have just ordered for Gyakye Quayson’s seat to be declared vacant rather than deletion of his details from the records.
But Attorney General, Godfred Yeboah Dame objected, maintaining that there were no errors in the ruling of the Supreme Court.
The 9-member panel, chaired by Chief Justice Gertrude Torkornoo noted that its decision was lawful and ruled that the application review was without merit.
She explained that lead counsel for Gyakye Quayson, Tsatsu Tsikata was repeating an argument that had already been made before the court adding that a review is not an appeal to warrant the repetition of the same points.
“The High Court in cape coast exercises jurisdiction different from that of the Supreme Court.
The applications for review is dismissed totally as without merit,” Chief Justice Torkornoo noted.
Lawyers for Gyakye Quayson are back at the apex court for the review application of the High Court’s ruling on the daily hearings of the Assin North Member of Parliament.
