The Kadehene, Osabarima Agyare Tenadu II, says he does not want any blood to be shed in his traditional area because of the chieftaincy dispute. He has, therefore, called on authorities to ensure that law and order prevail in the Eastern Region town.
These Authorities include the Eastern Regional Minister, the Regional Security Council (REGSEC), the Chief Justice, Attorney General, Minister of Defence, Minister for Chieftaincy and Religious Affairs, Minister for National Security and Speaker of Parliament among others.
It would be recalled that on December 21, 2022 the National House of Chiefs in the Eastern Region entered the name of Asaretwe II into the Register of National House of Chiefs as Chief of Kade.
Following the decision, Osabarima Agyare Tenadu II, the Chief of Kade, who was being removed per the House of Chiefs judgement, challenged the decision and promptly filed a Notice of Appeal at the Supreme Court and followed it up with a “Motion of Stay of Execution” at the very same judicial Committee of the National House of Chiefs.
The legal effect of those two processes is to put an ice on the decision of the National House of Chiefs Judicial Committee.
Addressing a news conference at his palace at Kade on Wednesday, this week, Osabarima Agyare Tenadu II referred to a ruling by a High Court in Kumasi and emphasised the significance of legal processes.
“The Court ruled that, the decision of the National House of Chiefs to enter the name of Asaretwe in the National Register of Chiefs as new Kadehene (Chief) was tainted with ‘illegality’.
The Court said the act was also ‘procedurally improper, unfair, unreasonable and same was in breach of natural Justice’, he said.
The High Court, as a result, granted an order of injunction restraining the National House of Chiefs (NHCs), its agents, assigns and workmen, from entering the name of Asaretwe II in the National Register of Chiefs, as Chief of Kade.
The Kadehene emphasised that, “it’s running up to three years, but the reasons to delay him have not been given; thereby disabling the Supreme Court from acting on the appeal.”
He, however, called for peace to prevail because he does not “want a single drop of blood to be shed in Kade over Chieftaincy”
“I am the valid sitting legal chief of Kade. It is not proper nor lawful for Twum Barima Otibu Asare, Yaw Berchie Darko Ampem Yaw Danso and their followers to disturb the peace in Kade,” he said.
Mr Nkrabeah Effah Dartey, Counsel for Osabarima Agyare Tenadu II, who also addressed the media, highlighted his legal standing as the rightful Chief of Kade, stressing that he will continue to carry out his functions as Kade Chief and will not tolerate any stampede to his authority.
