The constitution does not recognize the concept of the Majority and Minority sides in Parliament, Dean of the University of Professional Studies, Accra (UPSA) Law School Professor Ernest Kofi Abotsi has said.
Prof Abotsi explains that this concept came as a result of parliamentary law and practice.
In a post on his X page, he said “The concept of “ majority” & “minority” sides in Parliament are not constitutionally recognized; they are creations of parliamentary law & practice. Can they legitimately be the subject of a declaration of unconstitutional violation?”
His comments come at a time when the Supreme Court has by a 5-2 majority decision upheld the suit filed by Alexander Afenyo-Markin.
The apex court said the full reasons will be made available today Wednesday, November 13.
The suit filed by Afenyo-Markin brought a stalemate in Parliament as the NDC members assumed the Majority position based on the Speaker’s ruling. This prompted the New Patriotic Party Members of Parliament to boycott proceedings of the House.
With the latest ruling by the Supreme Court, Parliament is expected to be recalled with the NDC MPs reverting to their original Minority status.
