Six out of the ten accused who attacked Dome Kwabenya District Police Station in January 2018 and freed suspects in custody have been discharged by the Accra Circuit Court yesterday.
This is because the prosecution failed to adduce evidence against them.
They are Theodore Banda, a trader, Owusu George, Edward Lartey, George Yeboah, George Sarbah and, Elvis Asante.
Presiding Judge, Mr. Aboagye Tandoh in his ruling on submission of no case by counsel for the accused said, he would not join the ‘wild goose chase for evidence’ by the prosecution to incarcerate the accused persons.
The court, however, asked the other four to open their defence as a prima facie case had been established against them.
It is recalled that in April, the court sentenced two of the suspects, Emmanuel Kotey and Kofi Darko, to 66 months in prison.
Meanwhile, two other accused, Prince Osei and Atta Kwadwo who escaped police custody during the incident were sentenced to 30 months in prison each.
The facts according to the prosecutor Superintendent Kwaku Bempah are that, the accused on January 21, 2018, attacked the Kwabenya Police Station, and freed their colleagues, who were detained for various crimes.
He said two of the accused who went to the police station, pretended to lodge a complaint, entered the charge office, and told the officer at the counter that someone had borrowed their money and refused to pay back.
Supt.Bempah said Robert Owusu a policeman and witness in the case, then in charge advised them to initiate civil proceedings against them in court.
Few moments later, the two signaled their colleagues who laid ambush and they attacked the police station resulting in the death of Inspector Emmanuel Ashielevi, who was on duty and held two others hostage.
The prosecutor told the court the accused took the keys to the cell and released inmates, namely Chibuzor Akwuba, believed to be a Nigerian, Emmanuel Kotey, Rockson Edem, Dickson Ofori, Osei Kwadwo and Kofi Darko.
