President Nana Akufo-Addo says Kissi Agyebeng is fit and eminently qualified to be nominated to become the next Special Prosecutor of Ghana. The President has, therefore, accepted his nomination as the Special Prosecutor, with the hope that Parliament would expedite action on his approval.
This was contained in a release signed and issued yesterday by Mr Eugene Arhin, who is the acting Director of Communications at the Office of the President, Jubilee House.
Following his satisfaction, Nana Addo, has, by a letter to the Speaker of Parliament, Rt Hon Alban Bagbin, dated April 29, 2021, sought Parliament’s approval for the appointment.
If he is approved, Mr Kissi Agyebeng, who is a specialist in criminal law, would become Ghana’s second Special Prosecutor, and the youngest to occupy the position.
The nominee studied Bachelor of Law (LLB) Degree at the University of Ghana, Legon, and had his Masters of Laws (LLM) degrees from Dalhousie University and Cornell Law. He was called to the Ghana Bar in October 2003, and also taught as a Criminal Law Lecturer at the law faculty of the University of Ghana, Legon.
Mr Agyebeng is noted for being interested in criminal law practice as a private legal practitioner, due to his specialisation in Criminal Law.
The following is the full statement issued on behalf of the President.
“Nana Addo Dankwa Akufo-Addo, has accepted the nomination of Mr. Kissi Agyebeng as Special Prosecutor, and has by letter to the Speaker of Parliament, Rt. Hon. Alban Bagbin, dated 29th April 2021, sought Parliament’s approval of the appointment.
“It will be recalled that President Akufo-Addo accepted the resignation from office of Mr. Martin Amidu as Special Prosecutor on 16th November 2020, and, in accordance with section 13(8) of the Office of Special Prosecutor Act, 2017 (Act 959), is required to appoint a replacement within six (6) months of the position becoming vacant.
“To this end, the Attorney General, Mr. Godfred Yeboah Dame, on 16th April 2021, nominated Mr. Kissi Agyebeng, under section 13(3) of Act 959, to the President for consideration as the second occupant of the Office of Special Prosecutor.
Having been called to the Bar in October 2003, holding a Bachelor of Laws (LLB) degree from the University of Ghana and Master of Laws (LLM) degrees from Dalhousie University and Cornell Law School, being a Criminal Law lecturer at the Faculty of Law, University of Ghana, Legon, and also engaged in private law practice, President Akufo-Addo deems Mr. Kissi Agyebeng as being eminently qualified to become Special Prosecutor.
The President is hopeful that Parliament will expedite the confirmation process of Mr. Kissi Agyebeng, so he can assume the position without delay.”
Background
Ghana’s first Special Prosecutor, Mr Martin A K B Amidu willingly resigned from his position as the Special Prosecutor after he had occupied that office for little over two years.
Following his decision to honourably resign, President Akufo-Addo accepted his resignation from office on 16th November 2020 in accordance with section 13(8) of the office of special prosecutor Act,2017.
Act 1959 is required that in an instance the position of the Special Prosecutor became vacant, there ought to be replacement within six months of the office becoming vacant. It is in fulfilment of this that the Attorney General, Mr Godfred Yeboah Dame on 16th April 2021 nominated Mr Kissi Agyebeng under section 13 (13) of the Act 1959. The Attorney General’s nomination of Mr Kissi Agyebeng was subjected to the consideration of president Nana Akufo-Addo who has overwhelmingly accepted him.
