The Member of Parliament (MP) for Assin Central, Kennedy Ohene Agyapong, was yesterday scheduled to appear before an Accra High Divisional Land Court, presided over by His Lordship Justice Amos Wuntah Wuni, but the failed to do so.
His lawyers, led by Kwame Gyan, explained to the court that Kennedy Agyapong failed to appear as a result of post Covid-19 conditions he suffered after the court’s Friday sitting.
According to him, after the last sitting, a mutual agreement between the court and the legal team for Kennedy was reached, and yesterday, September 28, 2020, was set for the continuation of the proceedings that begun earlier this month, but the unusual happened.
He indicated to the court that after they left the court that Friday, Kennedy suffered complications from the Covid-19 illness he suffered last month.
“We arranged for him to seek medical support, and the diagnosis of the doctor who treated him for the Covid-19. We have [respectfully] attached the medical report and a cover letter to the court for its favourable consideration,” he said.
He asserted that it was not out of disrespect or wilful conduct that Kennedy was not able to appear before the court on Monday morning.
“The court’s records would reflect that since the service of the court order, via substitution, the applicant has consistently been in court ahead of time. This is our prayer, and we beseech you to allow us an adjournment so we can get the defendant restored to a clean bill of health,” lawyer Gyan prayed.
Justice Wuntah Wuni heard the lawyer’s prayer and adjourned the case to October 12, 2020.
Since the excuse for the lawyer maker was a health challenge, Justice Wuntah Wuni ordered that the Medical Officer, Dr. Ken Addo of Holy Trinity Medical Centre/Spa and Health Farm, appears before this court on Thursday Oct 1, 2020 to speak on the medical excuse duty.
The sitting judge said: “We have to create a country for ourselves because the way medical excuse duties are being written; somebody has to speak about it.”
Kennedy Agyapong is facing contempt charges as a result of comments he made about a judge who ruled against him in an injunction case.
Initially, the lawmaker argued that the High Court had no jurisdiction to entertain the case, but the sitting judge rejected the claim, as the court had the right, power and courage to punish anyone who scandalises its name.
