The Winneba High Court in the Central Region, presided over by Justice Aboagye Tanoh, has quashed the election that brought Dr. Andy Ofori-Birikorang to office as Pro-Vice Chancellor of the University of Education, Winneba, on November 21, last year, and ordered immediately fresh election.
Contrary to the university’s statutes, the Vice Chancellor of the university, Professor Afful Broni, reportedly nominated Dr. Andy Ofori-Birikorang as a candidate for the Pro-VC election.
This compelled the plaintiff – Dr Frimpong Kaakyire Duku – who is also a lecturer at the university, to seek redress at the court.
According to the court, Prof Afful Broni had no power under section 672 A and UEW statutes to nominate persons for the position of a Pro-Vice Chancellor, and awarded GH¢5,000 cost to the plaintiff.
Counsel for the plaintiff, Mr Alexander Afenyo Markin, who is also the Member of Parliament for Efutu, later told the media that he was satisfied with the ruling.
“The High Court in Winneba has held that University of Education statutes do not permit the Vice Chancellor to nominate for the purpose of electing a Pro-Vice Chancellor. Accordingly, the court quashed the decision of Professor Afful-Broni to nominate three persons for the election. In effect, the court pronounced that the Dr Afful’s decision cannot hold,” he stated.
According to him, the court ruling clearly vindicates the stance of his client, Dr Frimpong Kaakyire, who is a lecturer at UEW and a former University Teachers Association of Ghana (UTAG) President.
Dr Frimpong Kaakyire Duku sued the university over the processes for the election of a Pro-Vice-Chancellor.
He described the process of the election as “discriminatory and illegal.”
The lecturer alleged in his suit that the process was limited to a chosen few to the disadvantage of other equally qualified persons.
