A Sunyani High Court presided over by His Lordship Justice Patrick Baayeh has sentenced three persons into a 30 day imprisonment and also fined them GHC3,000 each or in default a further 60 days imprisonment.
The three convicted persons – Mr. Kofi Poku, Mr. Akwasi Nyamekye and Nana Effah Adomako, Akyeamehene of Nkoranza Traditional Council were sentenced for “willful/deliberate, disobedient and conscious attempt to scandalize and expose the administration of justice.”
During the pendency of the motion, Nana Okatakyie Agyeman Kodom IV, the Omanhene of Nkoranza Traditional Area who was the first respondent passed on to eternity; hence his name was struck out.
The applicants; Nana Adu Boahen, Nana Oheneba Afosa Kodom, Nana Osei Mensah Bonsu, Nana Akosua Baagyei and Nana Kwaku Kwaa as deposed to in their affidavit in support of the motion said on October 30, 2015, they instituted a chieftaincy petition against the respondents, seeking a declaration that the first respondent, that Nana Okatakyie Kodom is not a kingmaker of the Krontire stool of Nkoranza Traditional Area and as such any purported instruction for the installation of Kofi Poku as Krontirehene of Nkoranza Traditional Area is null and void;
Declaration that the first respondent cannot nominate, select and direct the Krontire Royal Family to install Kofi Poku as Krontirehene of Nkoranza Traditional Area;
Declaration that the purported direction and installation of the first respondent for the swearing of the oath of the Omanhene by the second respondent, Kofi Poku, as Krontihene of Nkoranza is an affront to custom, tradition and law and has no legal effect.
The applicants also sought an order of Perpetual injunction restraining the first respondent, his agents, servants, assigns, privies, etc, herein from allowing Kofi Poku to style, hold out, referred to, acknowledge as the Krontirehene of Nkoranza Traditional Area.
The applicants again sought perpetual injunction restraining Kofi Poku from swearing the oath of the Omanhene Okatakyie Agyeman Kodom as the Krontihene of Nkoranza Traiditional Area.
This injunction application was still pending and before the Brong-Ahafo Regional House of Chiefs could deal with the injunction application, the first, second and third respondent filed separate motions on notice for the dismissal of the chieftaincy petition.
The two applications are both pending, but in spite of the pendency of the motion for interlocutory injunction and respondents on application to dismiss the petition, the Respondents were ahead secretly to allow the second respondent to swear an oath of the Nkoranzamanhene as Krontihene of Nkoranza, when he had not been so nominated/selected and installed as Krontihene.
It is these acts of the respondents that the applicant consider as contemptuous of court which put the administration of justice to public ridicule and show gross disrespect of the administration of justice.
In his judgement, his lordship Justice Patrick Baayeh said he find the behavior of the respondents very irresponsible, which could have triggered serious breach of peace in the Traditional Area, and, therefore, deserve to be punished to set as example to other like-minded people.
He consequently sentenced each of the respondents to a term of 30 days imprisonment and a fine of GHC3, 000 each or in default a further 60 days imprisonment each.
