Accra, Jan. 14, GNA - A 41-year old Caterer, who was accused of having anal sex with a 15-year old boy at Adabraka, has been acquitted and discharged by an Accra Circuit Court.
This was after the court presided over by Mrs Abena Oppong Adjin-Doku in her judgement declared that the prosecution could not prove beyond reasonable doubt the charge of defilement levelled against Kenneth Nana Kwasi Amoako Attah.
The judgement was read by Mrs Jane Harriet Akweley Quaye.
Chief Inspector Kofi Atimbire prosecuting, narrated that the complainant is a Retired Laboratory Technician and grandparent of the victim.
The complainant resides at Dansoman.
The victim resides with her mother at Adabraka in a family house. Amoako Attah, a cousin to the victim, also resides in the family house.
The Prosecution said the victim runs errands for Amoako Attah and due to that Amoako Attah sometimes lure the victim into his room and on numerous occasions had anal sex with him in a sofa in his sitting room and also in his bedroom since December 2015.
According to prosecution, the victim said the last sexual act occurred in April 2017 of which Amoako Attah threatened to kill him if he revealed it to anyone.
According to the Prosecution the victim kept the ordeal to himself until his mother visited the complainant to spend the Easter holidays with him.
Prosecution said the victim started behaving strangely and so he was sent to a church at Adabraka for prayers.
He said during church service the victim disclosed the sexual acts with the accused,so the pastor in charge recommended that he should be taken to the hospital.
Prosecution said when the victim was sent to the Korle-Bu Polyclinic, after examination, the medical doctor on duty confirmed that the victim had been defiled.
A report was then made at the Domestic Violence and Victim’s Support Unit in Accra upon which the accused was arrested.
