Lawyers for the 2nd Respondent Akufo-Addo in the ongoing 2020 Presidential Election Petition has filed a memorandum specifying the issues their client wants determined by the Supreme Court.
As part of the pre-trial, parties to the case – the petitioner, 1st Respondent and 2nd Respondent, are expected to file the memoranda of issues for them to be agreed upon and determined. 3news.com has sighted that of the 2nd Respondent which contains 3 issues as follows;
1. Whether or not the Petition is incompetent and discloses no reasonable cause of action in terms of Article 64 (1) of the Constitution, 1992.
2. Whether or not the errors and alleged vote padding complained of by the Petitioner, granted same to be true, affect the outcome of the Presidential Election held on 7. December, 2020.
3. Whether or not there is a basis for Petitioner’s claim that neither Petitioner nor 2. Respondent obtained more than 50 percent of the total number of valid votes cast at the Presidential Election held on 7th December, 2020.
Lawyers for the 2nd Respondent also added a notice that their client “will pray that issues 1 and 2 be set down for preliminary legal argument”.
