THE INCLUSION OF PARTISAN POLITICS EITHER DIRECTLY OR INDIRECTLY IN LEGAL AND JUDICIAL ADMINISTRATION IS THE BEGINNING OF UNSAVORY POLITICAL RIVALRY, WHICH HAS THE TENDENCY TO DISTORT DEVELOPMENT AND NATIONAL COHESION
Partisanship politics is the struggle for political power to rule the people, this struggles sometimes leads to hatred, enmity, wrangling and possibly violence which later distorts citizens from coming together to work in a nationalistic and patriotic perspective to augment the development and growth of their country.
Legal and judicial administration is a constitutional body that exist to objectively deal with crisis in contemporary governance, eg corruption, mismanagement, embezzlement, misappropriation, insecurity, and many others just to mention a few, this same judicial and legal system also deal with corporate and societal problems to ensure equity, transparency, accountability and safety in the society and the corporate environment as well (industry).
Now, the judicial and legal system is the last alternative to cool down the tension that might have arisen from the struggle to capture power from electorates to rule them, that’s why the deliberate inclusion of partisan political egoism in the administration of law and justice, is the beginning of unsavory political rivalry which is obviously tantamount to the distortion of national cohesion as well as development and growth.
In a democratic system of government, where power is transient, ie: where power is given to more than one political party by the electorates to govern them, the involvement of Partisanship politics in the administration of law and justice, in that caliber of system, will create a fertile ground for what I called political witch haunting anytime power is given to a different political party, their opponents will surely be haunted, like we are seeing today, which to me is unfortunate, since it has the likelihood to negatively affect peace, unity and love among us, and there’s no country that can see development when there’s no cohesion between political actors from different political parties.
I subscribe to the principles of probity, equity, transparency, accountability, and justice, but the approach to realize these principles is what is making Ghana losing billions of dollars almost every day, there is so much preferential treatment in the political space when it comes to the fight against corruption, the above social principles needn’t the involvement of political, tribal, ethnic, religious, and gender considerations when administering them, but what do we see in Ghana today? Partisanship politics everywhere even in our judicial system, we see comprehensively Partisanship politics, in the promotion of judges, adjudication of justice and many other instances.
If not a political motivation, why a High Court of law can exercise a little patience for an accused person who filed for a suit of no case in the appeal court of law to exhaust that available remedy before passing judgment on that same person as guilty? Is this not undermining the authority of the appeal court of law?
At least it’s not for nothing that, our judicial system made available different types of law courts, from the magistrate courts, circuit courts, high courts, appeal’s courts and Supreme courts. The appeal court exists to administer appeal cases from appellants who feel dissatisfied with judgment passed on them from other law courts, so the High Court in the case of the state Vrs the former NCA officials could have granted them a mercy to be heard in the appeal’s court before further trial.
I finally appeal to my fellow politicians to let us work in a patriotic and nationalistic perspective to develop mother Ghana through the separation of partisan politics from the administration of law and justice
